The State Labour Inspection Service under the Ministry of Labour and Social Protection of Population of the Republic of Azerbaijan is an executive power body that exercises state control over compliance by employers regardless of their ownership and organizational-legal form (i.e. legal entities of the Republic of Azerbaijan, branches and representative offices of foreign legal entities and natural persons operating in the territory of the Republic of Azerbaijan) with the Labour Code of the Republic of Azerbaijan and other normative legal acts included in the labour legislation system of the Republic of Azerbaijan.
In its activity, the Service follows the Constitution of the Republic of Azerbaijan, laws of the Republic of Azerbaijan, decrees and orders of the President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, international agreements to which the Republic of Azerbaijan is a party, the Regulation of the Ministry of Labour and Social Protection of Population of the Republic of Azerbaijan, orders of the Minister of Labour and Social Protection of the Population and the Regulation of the Service. While performing its duties and exercising its rights, the Service interacts with central and local executive authorities, trade unions, employers' associations, local self-government bodies, as well as international and non-governmental organizations.
The Service has an independent balance sheet, state property, treasury, and bank accounts at its disposal in accordance with the law, stamp reflecting an image of the State coat of arms of the Republic of Azerbaijan and The Service” s name, relevant seals, and letterheads.
The Service participates in the development of state policy in the field of state control over compliance with labour legislation and ensures the implementation of that policy within its powers.
The service carries out state control in the field of compliance with labor legislation, raises issues before the relevant state authorities to bring the persons guilty of violating the labour legislation to administrative responsibility in the cases and in the manner determined by the Code of Administrative Offenses of the Republic of Azerbaijan, and to bring them to other responsibilities, as üell as provides to employers and employees methodical assistance on the application of legislation.
The Office of the Service, divisions by regions, stationary and mobile labour protection laboratories and the State Labour Inspection Service of the Nakhchivan Autonomous Republic form a single system of the Service. The Service is headed by the head of the Service, who is appointed and dismissed by the Minister of Labour and Social Protection of Population of the Republic of Azerbaijan.
There are three deputies who are appointed and dismissed by the Minister of Labour and Social Protection of Population of the Republic of Azerbaijan based on the presentation of the head of the Service.
