President Ilham Aliyev has approved the law "On Amendments to the Law of the Republic of Azerbaijan on Pensions."
The new amendment to Article 8 of the "Law on Pensions" will create the possibility for individuals eligible for pension benefits under favorable conditions for having children (with a reduction of the pension age limit by 5 years) to have their pension determined proactively.
Until now, individuals with five or more children were required, under favorable conditions, to raise and nurture those children until the age of eight in order to qualify for pension benefits. This requirement was only confirmed based on the request submitted by the citizen.
With the new amendment, this requirement is now eliminated, removing any obstacles to the proactive determination of this type of pension.
Additionally, Article 8.1 of the law stipulates that women who raise adopted or foster children up to the age of 8, in addition to their own children, and when the total number of children, including their own, is five or more, will also have the right to early pension by 5 years. With the new amendment, this right will be granted under the condition that the children brought into adoption or foster care have lost both parents or have been deprived of parental care.
Furthermore, parents of disabled children, as well as individuals who have taken guardianship of a disabled child up to the age of 8, will also be eligible for pension benefits under favorable conditions for having children.
This aims to incentivize the care of children in need of adoption or guardianship, who are placed in relevant state institutions, within the family care.
Moreover, until now, fathers who had five or more children, or who had a disabled child, and who continued to raise them alone until the age of eight due to the death of the mother, deprivation of parental rights, or termination of marriage with the mother, were granted the right to early pension by 5 years without remarriage. The new amendment envisages the inclusion of this right for these fathers even if they enter into a subsequent marriage.
