Survivor’s pension

The following family members have the right to a survivor’s pension:

1.1. Children of deceased persons:

1.1.1. Under 18 years of age;

1.1.2. A person with a disability over the age of 18 whose disability has been determined before reaching the age of 18;

1.1.3. Those studying full-time in educational institutions, but up to the age of 23;

1.2. If the father, mother, husband, wife has reached the retirement age determined in accordance with Article 7 of the Law "On Labour Pensions", or if the person is disabled due to 61-80 percent or 81-100 percent impairment of body functions;

1.3. Regardless of age and working capacity, if one of the parents or the husband (wife), or grandfather, grandmother, brother, sister takes care of the children, brothers, sisters, grandchildren under the age of 8 of the deceased person and does not work.

 

How to apply:

A citizen can apply to the regional branch of the State Sovial Protection Fund or to the DOST centers in person or through a representative under a power of attorney.

 

Documents required for the determination of survivor’s pension:

1. A copy of the identity card of the person who is assigned a labour pension (in the case of foreigners and stateless persons, a copy of the permit card granting the right to permanent residence in the territory of the Republic of Azerbaijan);
2. Certificate of the representative of the head of the local executive power on the administrative territorial district or on the field administrative territorial district about the family composition of the deceased person;
3. A copy of the birth certificate of the child (children) of the deceased head of the family;
4. A copy of the death certificate of the head of the family (or a court decision to declare him missing or dead);
5. Certificate of the educational institution about the formal education of the child (children) of the deceased person up to the age of 23;
6. Extract on the results of the medical and social expert examination on the disability of the deceased person’s child (children) over 18 years of age whose disability has been determined up to the age of 18, as well as on the presence of disability due to 61-80 percent or 81-100 percent impairment of body functions of the father, mother, wife, husband;
7. certificate of the district (city) registration department of the Ministry of Justice of the Republic of Azerbaijan on the non-marriage of the widow (husband) of the deceased head of the family;

8. A document confirming the fact of the death, cause, and date of death of the military serviceman, as well as the missing serviceman (when the right to a labour pension arises according to Article 17.2 of the Law “On Labour Pensions”) from the military unit, the state service bodies for mobilization and conscription, and other relevant state bodies.

 

The amount and duration of the survivor’s pension:

Based on the insurance indicators, the amount of pension is determined according to the pension capital accumulated in the individual account.
Note: the amount of the minimum pension is 280 manats.
The survivor’s pension is determined for the period when the specified conditions exist. For those who have reached the retirement age defined by law, it is assigned for life.

Individuals have the right to receive social benefits in the cases provided by the legislation if the right to survivor’s pension does not arise.
