Additional Leave

Additional Leave

Labour leave consists of two parts basic and additional The additions to labour leave are divided into three types:

  • Additional leave based on working conditions and the nature of job functions;
  • Additional leave based on length of service;
  • Additional leave for women with children.

Who is entitled to additional leave?

The following employees are granted additional leave based on working conditions and the nature of their job functions:

  • Employees engaged in underground work;
  • Employees working under harmful and heavy conditions;
  • Employees whose job functions involve high sensitivity stress and mental and physical strain.

Duration of additional leave

The duration of additional leave granted based on working conditions and the nature of job functions shall not be less than six calendar days The list of harmful and heavy industries occupations and positions that entitle employees to additional leave based on the nature of working conditions together with the duration of such additional leave shall be approved by the relevant executive authority

Depending on the length of service employees shall be granted additional leave as follows with length of service from five to ten years — two calendar days with length of service from ten to fifteen years — four calendar days with length of service exceeding fifteen years — six calendar days

The duration of additional leave based on length of service shall be determined according to the period during which the employee has actually worked under an employment contract with the employer This length of service shall include in addition to the period actually worked under the employment contract the periods of temporary incapacity for work as well as the periods during which the employee’s workplace and average salary are retained in accordance with Article 179 of this Code

Note

Regardless of the duration of basic and additional leave women with two children under the age of fourteen shall be granted additional leave of two calendar days and women with three or more children of that age as well as those with a child with disabilities shall be granted additional leave of five calendar days Fathers raising their children alone as well as persons who have adopted children shall have the right to the additional leave provided for in the first part of this article The right to additional leave established by this article shall also be retained until the end of the relevant calendar year in cases where one of the children reaches the age of fourteen.
