State Health Insurance and Expertise Agency (hereinafter referred to as the "Agency") is a public legal entity operating in the field of the implementation of mandatory medical insurance in the Republic of Azerbaijan, the accumulation and management of funds within the mandatory medical insurance fund to finance medical services, as well as the provision of medicines and medical devices to the insured within the framework of the service package, acting on behalf of the state as the centralized purchaser of medical services and payer of expenses for mandatory health insurance, and the determination of disability and the final medical examination of citizens called up for active military service (hereinafter referred to as the "relevant field").
The Agency operates under the Ministry of Labour and Social Protection of Population of the Republic of Azerbaijan (hereinafter referred to as the “Ministry”). In carrying out its activities, the Agency is guided by the Constitution of the Republic of Azerbaijan, the international treaties to which the Republic of Azerbaijan is a party, the laws of the Republic of Azerbaijan, this Charter, other decrees and orders of the President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers, the Ministry’s normative legal acts, and the orders and directives of the Minister of Labour and Social Protection of Population. In the performance of its duties and the exercise of its rights, the Agency cooperates with state and local self-government bodies, international and non-governmental organizations, as well as other legal entities and individuals. The Agency carries out activities of national and public importance.
To achieve the objectives set forth in this Charter, the Agency may engage in entrepreneurial activities. The Agency has an independent balance, property, treasury and bank accounts, and a seal bearing the name of the Ministry and its own name, as well as the image of the State Emblem of the Republic of Azerbaijan in accordance with the Law of the Republic of Azerbaijan “On the Rules for the Use of the State Emblem of the Republic of Azerbaijan”, together with the relevant stamps and letterheads. In accordance with the legislation, the Agency has the right to enter into transactions, acquire and exercise property and non-property rights in its own name, and assume corresponding obligations. The Agency may appear before courts as either a claimant or a defendant.
The Agency’s principal areas of activity include promoting the development of the relevant field, submitting proposals to the Ministry on the formulation of state policy in the relevant field and participating in its implementation, cooperating with competent state authorities (institutions), contributing to the development and implementation of policy proposals, enhancing efficiency, transparency, and service quality, including through the digitalization of services and support for innovative ideas and initiatives, implementing mandatory health insurance for the population and ensuring its financial sustainability, promoting equal access to medical services provided under mandatory health insurance and ensuring the universal accessibility of the system, taking measures to improve the quality of medical services, as well as the efficiency of the use of medicines and medical devices in order to protect public health, conducting disability assessments through the medical and social expert commissions within its structure, carrying out final medical examinations of citizens conscripted for mandatory active military service through its medical assessment commissions, participating in the work of multidisciplinary commissions responsible for preparing Individual Rehabilitation Programmes for persons with disabilities, and performing other functions assigned under this Charter.
