According to the legislation, an employment contract concluded between an employee and an employer constitutes the legal basis for their employment relationship.
When an employee works under an employment contract, they are entitled to:
• receive a salary not lower than the minimum amount established by law;
• participate in the social insurance system and acquire future pension rights;
• work in healthy and safe working conditions;
• take paid and unpaid leave;
• receive additional remuneration when required to work beyond normal working hours;
• be covered by compulsory medical insurance, compulsory unemployment insurance, and compulsory insurance against the loss of professional capacity resulting from accidents at work and occupational diseases; and
• exercise other rights provided for by law.
An employee who works without an employment contract is deprived of the above-mentioned labour and future pension rights. An employment contract acquires legal force when it is electronically signed by the employee and the employer through the “Labour and Employment” subsystem of the Ministry of Labour and Social Protection of the Population.
It should be noted that the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan has declared the period from August 21 to September 21 as the “Peace Month.” In the related appeal, it was stated that every initiative aimed at protecting human rights, raising legal awareness, and strengthening public solidarity and mutual trust is an investment in lasting peace.
